2. I was sort of being facetious regarding the court's cross-on-public-land decisions.

Particularly Salazar v Buono where a land swap was organized by Congress, in which the property on which the cross stands was transferred to private hands. The property is something like 100 sq ft carved from the middle of wildlife preserve.
