1. I have a somewhat more radical idea

I'm for abandoning the institution of marriage altogether at least as far as the state is concerned. If two people want to go to a church and profess their undying love for each other, more power to them, but you don't need the state involved in that. People are also free to enter into their own contracts with each other. You don't need the state involved in that either other than to settle disputes which the state already does for other types of civil contracts. Marriage, as a state defined institution, has outlived it's usefulness. If it didn't exist today, I doubt anyone would invent it. It's only purpose is to discriminate against individuals who are outside the bounds of what is considered traditional.
