Did Trump's Post-Presidential Calls to Putin Violate the Logan Act? - Glenn Kirschner



Bob Woodward's new book "War" reveals that after Donald Trump left the presidency he made many calls to Russian president Vladimir Putin.

The Logan Act is a federal law that prohibits private citizens from engaging in diplomacy with foreign countries to try to impact disputes with that country. Notably, if Trump violated the Logan act after he left office, the presidential immunity his Supreme Court Justices gave him will not protect him.

Of course, the Department of Justice would need to investigate Trump and determine if there is enough evidence to prosecute him. DOJ . . . if you're listening . . . - Glenn Kirschner - 10/09/2024.

It should be obvious he wasn't engaging in diplomacy. Gotta fill time, I guess.

Besides, as I noted below, no one has ever been prosecuting under the act, and it's very likely unconstitutional.

No one has been prosecuted under it since 1852.

A court noted in 1964 that it's most likely unconstitutional, but that hasn't been officially declared or determined.

Expecting the DOJ to pursue what is almost certainly a pointless exercise is unrealistic. Not that that will deter anyone.

And several former presidents have dealt with foreign governments, but they were sent by the then current administration, both former Presidents Carter and Clinton come to mind.
