(542 posts)The US Constitution, Art. 3, sec.1, second sentence, says "The Judges, both of the Supreme and inferior courts, shall hold their offices during good behavior ......."
This is a different standard than the "high crimes and misdemeanors" mentioned in Art. 2, sec. 4.
The good behavior standard seems to make judges more vulnerable to removal from office. So far as I know, it hasn't been used to remove a judge but the general trend of thought is that judges should be above suspicion and should be particularly upright in all their activities. So I think the good behavior standard could be used to remove Thomas and Alito.

(27,386 posts)If anything - good behavior just means that high crimes and misdemeanors is a lower standard than some people believe.
It still boils down to whatever two thirds of the Senate thinks that it is - but in practice there does seem to be a different standard for judges - as they are removed far more commonly
