UTC files injunction against San Juan and SPT for false representation

The Union of Capital Workers (UTC, for its Spanish acronym) of the municipality of San Juan, affiliated to the Transportation Union and Annexed Branches (UTRA), filed a preliminary and permanent injunction, declaratory sentence and damages against the municipality of San Juan, its Mayor and the Puerto Rican Workers Union (SPT).

According to Víctor Rodríguez, legal advisor of the UTC, the defendants behave in open violation of the provisions of Law 139 of June 1961, a law that allows and guarantees the constitutional right to organize workers in bonafide institutions.

“They made an ordinance that is totally unconstitutional because the Constitution does not allow municipal public employees to bargain collectively. They violate Law 139,” he said.

Rodríguez showed a certification issued in October 2016 by the Department of Labor and Human Resources and signed by Mr. Efraín A. De Luna Colón, assistant secretary of Legal Affairs and Standards, which demonstrates that an entity has not been certified as a bonafide organization Name Puerto Rican Workers Union, affiliated with the Service Employees International Union (SPT/ SEIU) in the Bureau of Services to Workers’ Unions.
