A gun-rights advocate, who stunned beach-goers in May when he strolled through a Redondo Beach park with a shot gun slung over his shoulder, dropped his lawsuit against the beach city.

Charles Nichols, an open-carry advocate, submitted a notice of voluntary dismissal without prejudice this week, dropping all of his claims against Redondo Beach.

Nichols was arrested and charged with a misdemeanor for carrying a firearm into a park. He ultimately pleaded no contest.

Nichols contended that the city's ordinance was preempted by state law and therefore invalid.

"Nichols was wrong about our ordinance being preempted by the state law," said Mike Webb, Redondo Beach city attorney.

Clearly, the actions of a reasonable person call for one to brandish a weapon in a sea-side public park.
