San Francisco Sheriff pleads to different charges and gets to keep his job

This is cross posted from the RKBA group (http://www.democraticunderground.com/117221689). It has some unique aspects that may interest members here.

Synopsis is that the SF Sheriff who was accused of domestic violence was allowed to plead to different charges to avoid Federal and State laws that would have barred his access to guns and being an LEO.

BELLEVUE, WA – -(Ammoland.com)- The plea deal announced this morning that allows anti-gun San Francisco Sheriff Ross Mirkarimi to keep his guns in what began as a domestic violence case “smacks of hypocrisy at the highest order,” the Citizens Committee for the Right to Keep and Bear Arms said today.

Mirkarimi pleaded guilty in San Francisco court this morning to what the San Francisco Chronicle described as “a misdemeanor charge of false imprisonment in connection with an incident in which he allegedly inflicted a bruise on his wife.”

“Why should Mirkarimi enjoy a double standard,” Gottlieb questioned. “Based on reports of what he allegedly did, any private citizen who did the same thing might be facing jail time. You can bet San Francisco prosecutors would not be cutting a deal that would allow that person to get his firearms back.

“Instead of getting his guns back under a sweet plea deal and retaining his job as sheriff,” he observed, “Mirkarimi ought to remain disarmed, and lose his job. Otherwise, from this date forward, San Francisco prosecutors need to apply the ‘Mirkarimi standard’ to every domestic violence case that hits their desk.


In the Gungeon and elsewhere many are focusing on a sweetheart deal done for the Sheriff, pointing out the double standard for LEOs. What is not being addressed is the domestic violence, which some activists claim runs higher in law enforcement community, but is suppressed out of professional courtesy. Many are surprised that this pattern of behavior by Mirkarimi was even made public.

San Francisco -- Mayor Ed Lee is suspending Sheriff Ross Mirkarimi from his post, the first step toward removing him from office permanently for official misconduct.

"He has chosen not to resign and now I must act," Lee said in a 5 p.m. news conference today. He said the sheriff's actions "fell below the standard of decency and good faith" needed for public officials.

Mirkarimi pleaded guilty last week to a misdemeanor charge of false imprisonment for an incident involving his wife on New Year's Eve.

Lee named Vicki Hennessy to serve as interim sheriff. Hennessy last ran the Department of Emergency Management after a career in the Sheriff's Department, where she retired as chief deputy.
