(16,690 posts)There is no way, at this point, to prevent him from taking office. After he takes office, the constitutional ways to remove him are few and all require the support, the MAJORITY support of his party and/or his cabinet. And in ANY of the cases, there is no mechanism for any new election. There is a long line of succession and NONE of it results in Hillary or ANY democrat being president.

(16,690 posts)I'm curious what grounds the SC would use to "block" the inauguration of a president. I'm speaking specifically of the text in the constitution that allows them to do this.

Hubby and I ended up talking about this at like 3am to 4am this morning, sitting up in bed in the dark. He is convinced that SCOTUS could take this on IF (and only if) someone with standing brings a case to them. They cannot act unless someone brings them something. Their precedent for interfering in a presidential election is that they already did that once. Granted, the circumstances were different, but they DID step in.
I wonder if anyone at all in DC is working on this. I wonder if anyone at all has the balls to proceed.

(16,690 posts)There is no mechanism for preventing an inauguration after the EC has voted and the congress has accepted. The SC has no authority to do that. He can take the oath of office from jail if necessary. The SC has no authority to address competency, only the cabinet can do that, and only AFTER he has taken the oath of office. Only congress can act at this point and it would be extraordinary if they did, and even they can't stop him from taking the oath.

So go to it, Democrats. 2018 is practically around the corner. What are our red meat issues that we should be putting on the ballot so our lazy voters will show up?

(2,124 posts)Unfortunately the electors are done and congress has certified the results. There is no stopping this train any longer.
If you think the Republicans in Congress are goin to turn on Trump, at least in the short time, it's just not going to happen.
Once he becomes President we on the left Wil be in the most powerless position in my entire life. Both at the federal, state and soon to be Supreme Court.
We must build from the ground up.
