http://www.freep.com/story/news/local/michigan/oakland/2015/10/06/cpl-holder-opens-fire-shoplifter-home-depot/73468588/A concealed-carry license holder is now cooperating with police after she opened fire on a shoplifter who was fleeing a Home Depot on Tuesday afternoon, Auburn Hills Police said.
The shooting happened in the stores parking lot at around 2 p.m., when Home Depot security was chasing a shoplifter in his 40s who jumped into a waiting dark SUV, said Lt. Jill McDonnell, an Auburn Hills police spokeswoman.
But when the SUV began to pull away, a 48-year-old woman suddenly began firing shots at the fleeing vehicle. The vehicle escaped but possibly has a flat tire, McDonnell said.
The woman who fired the shots has a license to carry a firearm and is cooperating with police.

...I don't understand how she can possibly not be charged.

... that they have't finished investigating. It's generally a good idea to gather all the necessary information before proceeding with arrests and indictments and all that. News media don't have those worries; they can just say "Oops!" and print a retraction.
Unless the fleeing shoplifters were trying to run someone down, the shooter will be charged. Surveillance footage and/or witnesses should be able to clarify that. I'd be willing to bet that there will be charges -- the question is how serious they will be.
