But it is the Senate that sits at the heart of our era of minority rule. Designed to guarantee the minority a voice but not veto power within a system of majority rule, the Senate’s minority protections have been inflated into tools of minority domination. The most important of those protections was the decision at the Constitutional Convention to give every state equal representation in the Senate, regardless of population size. At the time, the issue was highly contentious and nearly scuttled the entire convention. Today, the mismatch between the largest and smallest states has grown orders of magnitude greater than it was at the nation’s start. The Framers warned that even the comparatively smaller discrepancies that existed in their time would prove a dangerous source of injustice. That injustice is exponentially greater today than anything they imagined in their time.
