DOT joins 4 cities in West Virginia Paving lawsuits

The West Virginia Department of Transportation and Division of Highways filed an antitrust lawsuit against West Virginia Paving and other asphalt companies Friday, following similar lawsuits filed earlier in the week by Charleston and three other cities.

The DOT and DOH allege that the defendants — West Virginia Paving, Southern West Virginia Paving, Southern West Virginia Asphalt, Kelly Paving and others — have worked together to create a de facto monopoly, allowing them to charge inflated prices.

In many cases, the lawsuits allege, those companies were charging cities and the DOH 40 percent more for asphalt and paving than they should have.

West Virginia Paving released a statement that called the allegations in the lawsuits “blatantly false.”
