Albemarle judge upholds governor’s mask requirement in Virginia businesses
CHARLOTTESVILLE (WINA) – An Albemarle Circuit judge has ruled against WINA host Rob Schilling and Tobey’s Pawn Shop owner challenge of Governor Northam’s mask order. Judge Claude Worrell denied both a preliminary injunction as well as a motion of declaratory judgement and found Governor Northam’s Executive Order 63 essentially requiring masks inside Virginia businesses lawful.
Schilling and Tobey Bouch argued the Governor’s order illegally overrides Virginia’s law against wearing masks in public. Worrell wrote in his ruling that the plaintiff “is in error” the law itself explicitly states a Governor may waive the law in a public health emergency for a finite duration of time. The Governor’s order is set to end September 8th.
Schilling would not comment pending consultation with attorney Matt Hardin… and they can decide to appeal to the state Supreme Court.
