State opposes effort to reopen injection well case

The Ohio Department of Natural Resources is opposing the effort of an Athens-based group to reopen a case before the Ohio Oil & Gas Commission.
As previously reported, the Athens County Fracking Action Network is asking the commission to reconsider the commission's decision earlier this month to dismiss ACFAN's appeal of a December ODNR permit related to a K&H Partners injection well near Torch.
On Thursday, the state filed a response opposing ACFAN's effort to get the commission to reconsider its ruling.
ODNR is arguing that the commission is not allowed by law to reconsider the decision. The state's response cites a section of Ohio law that says an order of the commission "is final unless vacated by the court of common pleas of Franklin County in an appeal ..."
