Judge: Confederate statue can be moved by city

Judge Stanley Allen of Forsyth Superior Court rejected a request Thursday by the United Daughters of the Confederacy to stop the city of Winston-Salem from removing the Confederate statue at the corner of Fourth and Liberty streets.

Allen also ruled that the UDC’s lawsuit, which it filed Thursday against the city of Winston-Salem and Forsyth County, can proceed through the court system.

In his ruling, Allen said he didn’t fully understand the city’s urgency to remove the statue, but the UDC has had ample time to negotiate with city officials and Winston Courthouse LLC, the owners of the apartment complex next to the statue and the land where the monument sits, to resolve the statue’s future.

“Why has the Daughters done something at the 11th hour,” Allen asked. “TROs (temporary restraining orders) and injunctions are extraordinary measures that are not normally granted.”

The UDC has been negligent in not trying to negotiate with the city regarding the statue, Allen said.

The city intended to remove the statue Thursday night or in the next couple of days, Allen said. Before the hearing, city officials said removing the statue would take some time and would not happen today or during the weekend.

After the court hearing on Thursday, City Attorney Angela Carmon said that the city was pleased with the Allen’s ruling.

“The city is trying to protect the public against any unrest at the statue,” Carmon said.

Mayor Allen Joines said the judge’s ruling “validates the point that we had, that we are within our legal rights, and the property owners are within their legal rights, to ask that the monument be removed from the property.”
