Ex-Murphy staffer accused of rape seeks to get investigative files released before he testifies this week
Attorneys for Albert J. Alvarez, the former Murphy administration staffer forced to resign amid rape allegations, have gone to court seeking not only the criminal investigative files in connection with the charges, but also any surveillance recordings that might exist from the night of the alleged incident.
A judge issued an order to show cause on Friday requiring the Middlesex County Prosecutors Office to release its case files to Alvarez.
The request was not expected to derail Alvarezs appearance on Tuesday before the Legislature, committee officials said on Sunday, following their subpoena to him last week to answer questions about how he got his job with the administration.
Attorney Stacy Ann Biancamano in her filing late Friday said Alvarez was entitled to see the investigative files collected by prosecutors before being compelled to provide testimony to the legislative committee. But the panel has already agreed not to ask him about the rape allegations during his appearance.
