Ex-Ocean City lifeguard awarded $127K in age discrimination suit

CAPE MAY COURT HOUSE — A former Ocean City lifeguard who sued the city after being fired in 2011 for age discrimination won more than $127,000, according to a court order filed July 27 by Cape May County Superior Court Judge Noah Bronkesh.

The jury awarded Paul McCracken, of Linwood, $127,998.

In McCracken’s 2013 complaint, he claimed city officials targeted senior lifeguards due to their age when they removed $53,000 from the Beach Patrol’s 2008 budget.

He claimed the budget cut forced older lifeguards, like himself, who was 52 at the time he was fired, to face reduced pensions or to retire.
