Georgia brewers, distillers to be allowed to sell limited quantities
ATLANTA — Manufacturers will be able to sell distilled spirits and malt beverages in limited quantities directly to consumers after Gov. Nathan Deal signed into law House Bill 85 on Monday.
The law goes into effect Sept. 1.
Under the act, a license to manufacture distilled spirits now includes the right to sell up to 500 barrels at the distiller’s licensed premises for consumption both on- and off-premises. Sales for off-premises consumption, however, cannot exceed 2.25 ml per consumer per day, and the price for the take-home distilled spirit cannot undercut the price at which a person licensed to sell distilled spirits by the package is permitted to sell the distilled spirits.
For brewers, the legislation allows brewery patrons to purchase beer in taprooms and up to a case of beer for off-site consumption (a consumer can buy up to 288 ounces per day, the equivalent of 24 12-ounce bottles). The law permits breweries to annually sell up to 3,000 31-gallon barrels of beer, which the Georgia Beer Wholesalers Association says is the equivalent to approximately 1 million 12-ounce bottles.
On Tuesday, officials with the association thanked Deal for signing the bill into law, with GBWA Executive Director Martin Smith saying it continued the governor’s efforts “to keep Georgia as the top state in which to do business.”
