'Unlawful' Alachua County charter amendment proposal to stay on ballot, judge rules

GAINESVILLE, Fla. (WCJB) - Voters will get the chance to weigh in on the effort to return Alachua County Commission districts to at-large districts despite a judge ruling the proposal violates state law.

Alachua County Judge Olin Shinholser denied an injunction to keep the districts proposal off the ballot. He also ruled the ballot language is “unlawful.”

In the ruling, the judge explained that the county should have used the same ballot language for this proposal as the language used in 2022 which instituted single-member districts. The new language violates Florida law according to the judge.

The proposal is already on printed ballots, but if approved, the measure would be subject to additional legal challenges.
