This phrasing must get around the issue of age discrimination.

(36,207 posts)To create adverse impact. If it excluded 70% of people over 40, but only 10% of people under 40, for example, it would be said to create adverse impact on a protected group. The employer would then be required to show strong job relatedness. (Generally speaking)
Thats why EEOC objects to terms like this.
Its hard for individuals to win age discrimination cases (thanks in part to a RW USSC) but that doesnt make practices like this legal.
