Can Biden legally cancel student debt? There's no question.

In the Supreme Court case about challenges to President Biden’s student debt relief plan, three Republican former representatives — former speaker John A. Boehner (Ohio), John Kline (Minn.) and Howard P. “Buck” McKeon (Calif.) — filed a brief telling the court that “Congress” never authorized the plan.

But they certainly don’t speak for every member of Congress who voted for the law undergirding Biden’s plan.

During my time in Congress, I co-sponsored the Heroes Act of 2003, as well as a 2007 law making the act permanent. As I explained in my own brief in the case, the student debt relief plan is clearly authorized by the Heroes Act. A look at the text and history of the law makes that clear.

The Heroes Act gives the education secretary the authority to “waive or modify any statutory or regulatory provision” regarding federal student-loan programs as he or she “deems necessary in connection with a . . . national emergency.”

My loan got moved from DOE to MOHELA (MISSOURI Health and Education Loan Authority). Why? I have no idea. MOHELA was part of one of these suits.

AidVantage consolidated my loans. Again Why?

On Friday I got someone very helpful on the phone at MOHELA. Everything looks in order but I don’t have the right payment plan. DOE set up my payment plan but NOW it’s not okay. Once I set that up at student aid.gov (yes another operation- who I used to deal with) and load it up in MOHELA the next step takes 90 days THEN another 90 days if it’s approved. Oh that’s 90 business days so that cuts out the weekends.

My daughter's app has been approved. It'd sure be nice if this would be determined affirmatively before she gets done paying her student debt!

8. Does anyone know why he cancelled $10k and not all of it?

I recall multiple times when President Biden said he had the authority to cancel $10k and not the $50k that Sen Warren, Sanders, and others were advocating. Since the Heroes Act doesn't specify a dollar amount, does anyone know why it was limited? Seems like legally they could have cancelled 100% instead of targeting it like was done.
