LINCOLN — Outgoing Nebraska Secretary of State Bob Evnen said he’s baffled by a lawsuit that seeks to eliminate a provision in state law that allows U.S. citizens who’ve never lived in the country to vote in Nebraska elections.

The Republican top election official, who lost his party’s primary in May, spoke with the Examiner about a lawsuit filed by the Republican National Committee over a Nebraska state election law.

The RNC — joined in the lawsuit by Lancaster voters Jack Riggins and Pamela Dingman — objects to part of state law that says “a person who is the age of an elector and a citizen of the United States residing outside the United States, who has never resided in the United States, who has not registered to vote in any other state of the United States, and who has a parent registered to vote within this state shall be eligible to register to vote and vote in one county in which either one of his or her parents is a registered voter.”

Evnen said the number of people who have used this provision of the law to vote in Nebraska elections is almost nonexistent.

1. Hello Omaha Steve: I am not a Nebraskan; however...

...I thought breaking out a paragraph in your article might help with general understanding. My reading tells me that the person (or persons) to whom this might apply, would have ALREADY registered to vote (in Nebraska) BEFORE enlisting in the military.

The RNC (joined in the lawsuit by Lancaster voters J. Riggins and P. Dingman) objects to part of state law that says:

(1) A person who is the age of an elector

NOTE: In Nebraska, the minimum age to be an elector and register to vote is 18 years old. However, a 17-year-old is permitted to register and vote in primary elections if they will turn 18 on or before the date of the general election in November.

(2) And a citizen of the U.S. residing outside the U.S.

(3) Who has never resided in the U.S.

(4) Who has not registered to vote in any other state of the U.S.

(5) And who has a parent registered to vote within this state

(6) Shall be eligible to register to vote and vote in one county in which either one of his or her parents is a registered voter.

2. I read it as applying to the child of someone in the military

or the child of an expat.

The person registering to vote has never lived in the US, but has a parent who is a registered Nebraska voter.
