FBI is buying data that can be used to track people, Patel says

The FBI is buying up information that can be used to track people’s movement and location history, Director Kash Patel said during a Senate hearing Wednesday. It is the first confirmation that the agency is actively buying people’s data since former Director Christopher Wray said in 2023 that the FBI had purchased location data in the past but was not doing so at that time.

“We do purchase commercially available information that’s consistent with the Constitution and the laws under the Electronic Communications Privacy Act, and it has led to some valuable intelligence for us,” Patel told senators at the Intelligence Committee’s annual Worldwide Threats hearing.

The U.S. Supreme Court has required law enforcement agencies to obtain a warrant for getting people’s location data from cell phone providers since 2018, but data brokers offer an alternative avenue by purchasing the information directly.

Many lawmakers want to end the practice. Sens. Ron Wyden (D-Ore.) and Mike Lee (R-Utah) introduced the Government Surveillance Reform Act on March 13, which would require federal law enforcement and intelligence agencies to obtain a warrant to buy Americans’ personal information.
