WASHINGTON (AP) — Donald Trump laid the groundwork to try to overturn the 2020 election even before he lost, knowingly pushed false claims of voter fraud and “resorted to crimes” in his failed bid to cling to power, according to a newly unsealed court filing from prosecutors that offers new evidence from the landmark criminal case against the former president.

The filing from special counsel Jack Smith’s team offers the most comprehensive view to date of what prosecutors intend to prove if the case charging Trump with conspiring to overturn the election reaches trial. Though a months-long congressional investigation and the indictment itself have chronicled in stark detail Trump’s efforts to undo the election, the filing cites previously unknown accounts offered by Trump’s closest aides to paint a portrait of an “increasingly desperate” president who while losing his grip on the White House “used deceit to target every stage of the electoral process.”

“So what?” the filing quotes Trump as telling an aide after being advised that his vice president, Mike Pence, had been rushed to a secure location after a crowd of violent Trump supporters stormed the U.S. Capitol on Jan. 6, 2021 to try to prevent the counting of electoral votes.

“The details don’t matter,” Trump said, when told by an adviser that a lawyer who was mounting his legal challenges wouldn’t be able to prove the false allegations in court, the filing states. The brief was made public over the Trump legal team’s objections in the final month of a closely contested presidential race in which Democrats have sought to make Trump’s refusal to accept the election results four years ago central to their claims that he is unfit for office.

WASHINGTON (AP) -- Donald Trump "resorted to crimes" after losing the 2020 election, federal prosecutors said in a court filing unsealed Wednesday that argues that the former president disregarded the advice of his vice president and other aides and is not entitled to immunity from prosecution over his failed bid to remain in power.

The filing was submitted by special counsel Jack Smith's team following a Supreme Court opinion that conferred broad immunity on former presidents for official acts they take in office, narrowing the scope of the prosecution charging Trump with conspiring to overturn the results of the election he lost to Democrat Joe Biden.

The purpose of the brief is to convince U.S. District Judge Tanya Chutkan that the offenses charged in the indictment are private, rather than official, acts and can therefore remain part of the indictment as the case moves forward.

"Although the defendant was the incumbent President during the charged conspiracies, his scheme was fundamentally a private one," Smith's team said, adding, "When the defendant lost the 2020 presidential election, he resorted to crimes to try to stay in office."

Chump KNEW he'd lost. He KNEW he was doing illegal, unconstitutional stuff. He KNEW he had to convince others to go along with him or the plan wouldn't work. A whole bunch of people REFUSED to help him, and most of those people testified against him in the House Select Investigation of Jan. 6th. That testimony is available to the public.

If Judge Chutkan has opened a newspaper in the last 2 years she has to already know this. After the November 2020 election everything Chump did was outside of his normal "presidential" duties. Every phone call, every tweet, every meeting, every TV interview - were all guided by his desire to prevent Joe Biden from lawfully taking his place as the next president. Chump was not entitled to "presidential immunity" then or now.

I doubt that Judge Chutkan actually needs any convincing. What she needs is ammunition to get around that ridiculous immunity ruling, and this filing is meant to give that to her. I can't wait to read it!

Sondland is outright stupid about the Biden/Harris economy, and Ari fails to factcheck or follow up even about the most basic economic improvements like the historical jobs growth and lower crime.

Ari asks everyone to finish the sentence, "If Trump loses..."
--- 2 say it's because the people are sick of chaos and division
--- 1 says it's because he hasn't prosecuted his case the way Vance did last night
--- 1 says the MAGA line about how good things will be lost.

So glad and relieved I don't live in Republican world.

I don't agree that he corrals them much, though. Admittedly, as a Democrat I detest them as Republicans, and I'd detest seeing more Faux strategy from MSNBC, as if it could 'enlighten' undecideds.

And while MSNBC doesn't have to worry about its fact based reporting, Faux's big court loss has forced it to change its old propaganda programming.

Ari can fall back on this approach. He's used it too much to suit me when we already have corporate media sane washing. Especially when he knows how important the next 34 days are.

his unusual guests any other time (yeah, the Credico/Sater segment was something else), just not right before a national presidential election. If his approach results in more Harris votes, we'll never know.

Back in the day it was one of the "rules" I gave to my seniors when we worked at time strategies for staying on top of college studies, meeting deadlines, balancing that with needing peer approval. Which is why I jumped for joy the first time I heard Walz say it!

"The defendant also knew that he had only one last hope to prevent Biden's certification as President: the large and angry crowd standing in front of him. So for more than an hour, the defendant delivered a speech designed to inflame his supporters and motivate them to march to the Capitol," Smith wrote.


The lengthy filing -- which includes an 80-page summary of the evidence gathered by investigators -- outlines multiple instances in which Trump allegedly heard from advisers who disproved his allegations, yet continued to spread his claims of outcome-determinative voter fraud, prosecutors said.

"It doesn't matter if you won or lost the election. You still have to fight like hell," Trump allegedly told members of his family following the 2020 election, the filing said......................

types out there don't get that, but "the wheels of justice grind slow but exceedingly fine." If they don't, the bad guys get away with it. Thank you, Jack smith, for taking the time to do it right so Trump doesn't get away with his crimes.

Most of TFG's briefs opposing the release of the Special Counsel filing were claims that this was a partisan exercise and the facts in the filing should not be released so close to the election. In her opinion releasing the Special Counsel brief, Judge Chutkan called out TFG's counsel for advancing political rhetoric that has no basis in law. The best is when Judge Chutkan noted that TFG's claims are “unbefitting of experienced defense counsel
