Clarence Thomas says government institutions shouldn't be 'bullied' following leak of draft opinion

Justice Clarence Thomas, following the leak of a draft majority opinion overturning Roe v. Wade, said Friday that government institutions shouldn't be "bullied" into delivering what some see as the preferred outcome.
"The events of earlier this week is one symptom of that," Thomas said. He added that "you cannot have a free society" without stable institutions.
His comments came before an audience of mostly judges and lawyers at the 11th Circuit Judicial Conference in Atlanta. Chief Justice John Roberts had addressed the same conference Thursday, calling the leak "absolutely appalling."

On Friday, Thomas also reiterated that he believes Supreme Court justices are obligated to take a fresh look at established precedent and shouldn't be bound by the judicial doctrine called "stare decisis." The legal principle is translated as "stand by that which has been decided" and is meant to reinforce stability in the law. Thomas has long been a critic of a strict reading of the doctrine.

You can't have stable institutions if the people in them are not subject to the same rules the rest of the public is. Lying on a job application and/or an interview is grounds for dismissal in any private organization.

In the weeks between the 2020 election and the January 6 insurrection, Ginni Thomas sent multiple text messages to Mark Meadows, former President Donald Trump's chief of staff, urging them to challenge the election results. The texts were obtained by The Washington Post and CBS News.
"Do not concede," Ginni Thomas instructed Meadows in a text sent on November 6, 2020. "It takes time for the army who is gathering for his back."
Days later, after the election had been called for President Joe Biden, Ginni Thomas texted Meadows telling him to help Trump "stand firm," adding: "You are the leader, with him, who is standing for America's constitutional governance at the precipice. The majority knows Biden and the Left is attempting the greatest Heist of our History."
Some of the texts also included claims about voter fraud and cheered on efforts by Trump allies to challenge the results in court.
Her husband, along with the rest of the Supreme Court, ruled on some of those cases.

(5,141 posts)The Supreme Court needs to make its decisions based upon the law with a strong eye on the rights of the People involved.
These decisions may not be popular and may not make the majority of the People happy but the Court is not there to be popular but to adjudicate the law(s) as they are written.
The main reason for this is to prevent the "tyranny of the majority".
And, for the most part and with a few exceptions, that is exactly what they accomplish.
Because they are human, they will make mistakes and errors in judgment and interpretation, as we live within this form of government with checks and balances, We the People should rely on the other branches to use their powers of "check and balance" to steer the ship back to the correct course.

When the Supreme Court starts rolling those rights and that freedom back, it's going to be ugly in the aftermath. And where do they stop? If you take away this very private and personal decision, what's next? Can they decide who you'll marry? How you can vote? Where does it end?
This is very concerning (not in the Susan Collins way - I'm very concerned) and bodes ill for the future of our Country. I hope the ultimate opinion is different from what was leaked.

It's been downhill since it was packed with "yes" men, frat hall beer drunks (look at his teeth: projectile vomiting from lost weekends wears down the enamel), career misogynists and cultists with little or no knowledge about the law of the land.
