Leading House Dem sues Trump under a post-Civil War law for conspiracy to incite US Capitol riot

Former President Donald Trump and attorney Rudy Giuliani are being accused of conspiring with the far-right groups Proud Boys and Oath Keepers to incite the January 6 insurrection in a civil lawsuit filed Tuesday in federal court by the Democratic chairman of the House Homeland Security Committee that cites a post-Civil War law designed to combat violence and intimidation by the Ku Klux Klan.
The lawsuit, filed by Mississippi Democratic Rep. Bennie Thompson in his personal capacity, is the first civil action filed against the former President related to the attack at the US Capitol and comes days after the Senate acquitted Trump in his impeachment trial.
If it proceeds, it would mean the former President and others would be subject to discovery and depositions, potentially exposing details and evidence that weren't released during the Senate impeachment trial.

Other Democrats in Congress including Representatives Hank Johnson of Georgia and Bonnie Watson Coleman of New Jersey are expected to join as plaintiffs in the coming weeks, according to the N.A.A.C.P.
The lawsuit contends that Mr. Trump and Mr. Giuliani violated the Ku Klux Klan Act, an 1871 statute that includes protections against violent conspiracies that interfered with Congresss constitutional duties; the suit also names the Proud Boys, the far-right nationalist group, and the Oath Keepers militia group. The legal action accuses Mr. Trump, Mr. Giuliani and the two groups of conspiring to incite a violent riot at the Capitol, with the goal of preventing Congress from certifying the election.
The suit is the latest legal problem for Mr. Trump: New York prosecutors are investigating his financial dealings; New Yorks attorney general is pursuing a civil investigation into whether Mr. Trumps company misstated assets to get bank loans and tax benefits; and a Georgia district attorney is examining his election interference effort there.

(12,217 posts)Things that would fly under the radar, seemingly innocuous, that raise a flag within a larger context, as seen by well-trained and experienced people.
Some of it will be impossible for the cabal to get to. The "militia" cosplayers don't have the reach, and their actions will nail them anyway.
There is still evidence that even the players at the top of this dungheap won't be able to get to. IRS records, Deutsche Bank accounting, metadata from comm providers, and many more.
I'm hopeful on that front. What worries me is that a court might refuse to hear the case, on whatever grounds they can dream up.

(42,770 posts)He was very pessimistic about any legal option proceding related to the insurrection and Trump and his cronies. Bottom line he said if a political attempt couldn't work doubtful anyone would think a more restrictive legal process would work.
It was very disheartening. And it was curious to me. Preet was very non-emotional about it. He didn't seem to care at all.

Although the burden is much lower in civil than criminal court, I believe its just going to make more people say "enough of this crap"

(13,538 posts)From the ones who'd probably DIE for him to ones who'd probably take him out if they had a legit opportunity. But the ones in between are the decision makers. And i'm already hearing the "i'm sick of hearing about it; he's GONE" stuff. It has the possibility of a backlash among those. He's got plenty of bad news coming business wise; I'll take that.
