Acting appointments were meant to deal with situations in which a position is suddenly unfilled while Congress is not in session, so there's no chance to get Senate approval in the normal fashion. With the Senate in session when tsf begins his maladministration, he has no good excuse for temporary appointments.

Here's an article in the Miami Herald describing the situation -- with supine GOP leadership, it seems tsf will likely get away with it, at least in cases where he considers it worth holding out against (probably) minor resistance:

(This is a pretty good article, with two glaring inaccuracies: it refers to tsf's marginal win as a "resounding" victory, and tsf's approach is described as "pretty clever", rather than "insidious".
