Let's say the judge who will sentence Bannon goes for a middle of the road sentence. Bannon is facing up to two years. Lets' say the judge gives him one year. Bannon faces the possibility of being subpoenaed by a grand jury for the attempted coup, while he is in prison. They will not have trouble serving that subpoena.
Bannon was part of the conspiracy, the coup. Bannon is acting like a tough guy now, lets see what happens when a grand jury comes calling.
The same goes for Navarro. It is clear he and Bannon have been talking, planning together what they are going to do.
I predict a very bad ending for these two assholes.

(10,539 posts)He knew he would have to take these lumps if he wanted to stay popular with the Trump base. If he had honored the subpoena he would have had to plead the 5th a billion times which is not a good look. He is trying to reach martyr status so he can fleece the Trump cult again down the road. That is, if he doesn't spend most of the rest of his life in prison.

(9,647 posts)Given the nature of what he is refusing to testify about, and his open disrespect of the courts, I would think the judge would have no issue with a 2-year sentence.

(4,913 posts)He could get up to two years and I am pretty sure it is never a good idea to piss off a judge who is going to sentence you. That is exactly what Bannon did. He mocked, attacked the entire legal process. That can piss a judge off. If Bannon had plead guilty he probably could have gotten off with a smaller sentence.

(7,593 posts)It seems fair to make the imprisonment term the minimum (30 days) and then giving Bannon a one or two year probation where cooperation with he J6 committee is a condition of that probation. In that way, he essentially holds the keys to his own jail cell after the 30 days.

(8,905 posts)Another subpoena for the day after he gets out, and if he doesn't show up he goes back in for 23 more months. Something like that,,?
They could even stipulate he is to show up for a videotape appearance so he doesn't start bargaining to make it live.

(7,593 posts)On his first day in jail, serve him a subpoena that he must attend a deposition within 30 days of getting out. If Bannon fails to act, the DOJ asks the judge on day 31 to revoke probation and Bannon gets to serve another 22 months and change in jail.

I think the judge should have slapped a gag order on him until sentencing, though.
