I didn't read Alito's draft. I will, but I haven't yet.
Is there anything in there that addresses what actually happens in the real world? In other words, is HEALTH addressed?
For example, my wife miscarried years ago. What happens if the draft decision passes, and a woman miscarries? Is she suspected of performing her own abortion? Is that specifically addressed in the draft?
What if a woman is in a situation where giving birth will kill her, so an abortion must occur. Does the draft address that?
What if a baby will most likely be born alive, but will have deformities that are not compatible with life, and will die within hours?
There are any number of medical situations that could occur.
My question is: Have any of these even been ADDRESSED at all in the draft?
The more I think about this, the more horrible it becomes. If some asshole judges are making health decisions, I'm thinking that health consequences should be specifically addressed in the decision, but I'm sure they are not. All I've heard is that the decision is somehow based on some words spoken by some guy who killed "witches" in the 1600's?
What the fuck am I missing here?

(34,286 posts)That is why I'm thinking another justice might side with Roberts, but it could be wishful thinking on my part. Like the Texas law, most of the opinion lacks logic.

(63,221 posts)Especially when it comes to ectopic pregnancies, which usually kill both mother and fetus. These kinds of decisions need to be informed by medical experts and there needs to be a follow up plan.
Like how is society going to deal with all of these unwanted children and who is going to pay for it? How will young girls be protected from the family members or rapists who impregnated them, that is if they even survive the pregnancy? Will we be opening up orphanages like they had in Romania when abortion was outlawed there (complete disaster)? Will mothers be subsidized for keeping the children they are forced to bear? Etc....
Lots of details have not been thought out.

(22,648 posts)and I'm remembering the pain we felt, and how a lot of my own pain was due to seeing my wife's pain.
I remember kissing her as they wheeled her in for a procedure that needed to be done after the miscarriage. For some reason, I am focusing on that bonnet type of thing they put on your head before surgery.
And then I'm picturing some law enforcement officer giving her some shit, or "investigating" her during that terrible time.
I have some thoughts that I need to type out about this, but I'd get banned.

Don't think it's in there, therefore the answer is: it'll be up to The States cause R v W was federal overreach from the start.
That's pretty much the gist of the whole thing.
Same old Federalist Society crap.
Oligarchs don't like federal power, because that's bigger than them.
Billionaires love State Power because it makes them big fish in a small pond in whatever States they live/operate in, and it's easier for them to be in direct contact with state's politicians.
Long game-wise, this is predominately about kneecapping the power of the Federal Government if you ask me.
At least, for the people at the top of the food chain, the ones actually making this happen.
The rubes I'm sure think this is really about saving those poor widdle babies for Jeebus (oh, and keeping those sluts in check).

1. this isn't a women's issue because there's no such thing as rape cause he's an asshole
2. since this isn't a women's issue he can go back to "history and tradition" when women were chattel and treat it like a human issue only.

Even if the final decision does not diectly address all of your points, it is still a decision that will allow states to return to much of the barbarity of the past. Everyone's efforts should then be directed at legislatures which will be able to return Roe in a different, and
often messier, form.

(186 posts)but the biggest part of the issue is women who choose not to bear children for whatever reason. It IS a womans right to determine her health and her future as well as the future of any potential child she may carry!
The authorities need to get their noses out of womens uteruses. I cant believe we are being dragged back 50 years.
Alito may not be alone in his delight to justify overturning Roe v Wade but hes the new first in line for blame for this shameful act of declaring women dont have self determination rights.
