(4,089 posts)The Supreme Court power to determine the constitutionality of laws is not in the Constitution.
It is a claimed 'inherent power', grabbed early in the 19th century by the court.
The Supreme Court was created as the court of last appeal in deciding cases about application of existing law; not the constitutionality of the same.
The Constitution does give Congress some powers over the Court, such as deciding the number of Justices.

(13,431 posts)justices needs to change. A non partisan committee should choose the candidates based on their legal qualifications and take all the damn politics and dark money out of it. There are now 5-6 justices that are governing the country based on religious beliefs and not on law or on the will of the people. That is not even close to a democracy, how is it the majority of the country does not rule and that the republicans do not care about the majority, your system ensures them a seat to rule or obstruct the governing of the country.
