Appeals court dismisses Emoluments Clause lawsuit in win for Trump
The Fourth Circuit Court of Appeals on Wednesday dismissed a lawsuit filed by Maryland and D.C. alleging that President Trump is violating the Emoluments Clause of the Constitution, finding that they did not have the standing to sue the president.

Democrats subpoena Trump businesses in Emoluments Clause lawsuit
Lawyers for more than 200 Democratic members of Congress have served subpoenas to President Trumps businesses as part of their lawsuit alleging Trump is violating the Emoluments Clause.
The Democrats said in a press release that they have issued 37 judicial subpoenas to Trumps private businesses, including the Trump Organization, seeking information on payments from foreign governments.
The announcement came just hours after the Department of Justice (DOJ) asked a federal appeals court to block the lawsuit from advancing, following a district judge's ruling last month that the proceedings could move forward.
The DOJ and the Trump Organization did not immediately reply to requests for comment from The Hill.

This will not affect the case congress brought. It is about who has standing and congress does.

This was a unanimous decision, but of a 3-judge panel made up entirely of Republican appointees. Democratic appointees hold a 9-6 advantage on the 4th Circuit.
However - after reading the decisions, MD/DC make pretty thin arguments on standing.

Congress would almost certainly have standing... but a group of members of Congress is not the same thing.
