Fox News Legal Analyst Explains Why Don Jr. Could Be Going to Jail
Fox News judicial analyst Andrew Napolitano on Monday made very clear that in his opinion Donald Trump Jr. can now legally be charged for committing the crime of conspiracy.
The highly-respected Napolitano said this is true even if Russians did not give him damaging information about then-Democratic nominee Hillary Clinton, as he and others have always maintained.

During an appearance on Fox News Outnumbered program, Napolitano gave his in-depth legal response to President Donald Trumps tweet on Sunday throwing Don Jr. under the bus. The president posted that his son had arranged the meeting with a Russian lawyer at Trump Tower in June of 2016 to get dirt on Clinton that Trump could use in his campaign for president. This tweet seems to have increased the likelihood that Don Jr. will end up going to jail.
Concerning whether or not there was collusion Napolitano explained to the shows co-hosts:
There is no such law and there is no such word in the law as collusion, thats a Hollywood and media term. The legal term is conspiracy. If the Trump campaign and the Russians work together, but was there an agreement to work together?
The crime is the agreement. Whether the agreement was put into place or not. Thats what Bob Mueller is looking for.
Outnumbered Co-host Melissa Francis asked Napolitano why Hillary Clinton had not herself been charged with conspiracy for funding the research for the famous Steele dossier, which provided intelligence services with detailed information about connections between Trump and the Russian government.
Except that special counsel Robert Mueller is not investigating the Steele dossier, Napolitano replied, taking the wind out of Francis sails.
The Fox News legal analyst then continued by saying:
You may argue and Ive argued this unsuccessfully that an agreement that ends up not being carried out shouldnt be a crime but it is. Its the prosecutors favorite crime, its called conspiracy. Its the easiest to prove, all you need to know is who agreed and that one of them took a step in furtherance of the agreement.
What Napolitano has done with his comments is take away any doubt that Donald Trump Jr. committed at least one felony in setting up the June 2016 Trump Tower meeting. Not only that, but he also made clear that the crime is easy to prove and Mueller has all the evidence he needs to convict the younger Trump and send him to jail.

(33,643 posts)1) Something that proves without question that Trump Sr. was aware, and pre-approved the agreement,
2) Something that proves without question that 'the dirt' discussed in the meeting was, de facto, the stolen documents that were (soon after the meeting) released by DCLeaks and Wikileaks (I mean, I already know it is, but real proof would be HUGE),
3) Something that proves the Trump Campaign offered quid pro quo (i.e. Sanctions Relief) in exchange for 'the dirt being released', and
4) Something that proves the Trump Campaign KNEW they were entering into a conspiracy to, in effect, receive stolen materials, esp. if stolen by Russia but even if stolen by Seth Rich (haha), it would still be illegal
5) Something that proves the Trump Campaign changed their campaign strategy at the 11th hour, based on having access to stolen DNC docs that had electorate/demographic and other info they'd not have been privy to otherwise.
The last one could be a real killer because it looks like they actually DID do so, but I don't think that this info was ever released publicly (could be wrong but I don't recall it). Ergo, that'd mean someone(s) close to the campaign (Cambridge?) actually DID 'receive', physically or electronically ... stolen DNC info at some point, directly.
BTW, nothing will happen to Junior. This is just Faux Nooz BS, they wanna make it look like he could be in big trouble, that way when he's NOT, Dumpie can end up looking like the big strong hero his Cultist wannabe's so crave him to look like. "Look, The Donald is so tough even when Trump Jr. commits felonies nobody can touch The Donald cause he's so Powerful and Rich and Shit!"
It's Kabuki Theater at this point ... SO FAR, mind you. We start getting real proof of some of those 5 things ... look out.
